These Terms of Service ("Terms") govern your use of this website and the Memento Jar mobile application (together, the "Service"), operated by 23 Degrees, LLC ("23 Degrees," "we," "us"). By using the Service, you agree to these Terms.

Eligibility

You must be at least 13 years old to use Memento Jar. If you're under the age of majority where you live, you should have a parent or guardian's permission to use the Service.

Using the Service

Memento Jar is provided for your personal, non-commercial use. You're responsible for the content you create within the app — photos, notes, recordings, and anything else you add to your jar — and for keeping your device secure, since that content is stored locally on your device and is not backed up by us.

Prohibited uses

You agree not to:

• Reverse engineer, decompile, or attempt to extract the source code of the app, except where applicable law expressly permits it;
• Use the Service for any unlawful purpose, or in a way that infringes anyone else's rights;
• Attempt to interfere with, disrupt, or gain unauthorized access to the Service or its underlying infrastructure;
• Misrepresent your identity or affiliation in connection with the Service.

Intellectual property

The Memento Jar name, logo, app design, and website content are owned by 23 Degrees, LLC. You retain full ownership of the memories and content you create in the app — we don't claim any rights to it.

In-app purchases

Memento Jar may offer optional in-app purchases (such as removing ads). Purchases are processed through the Apple App Store or Google Play and are subject to their respective terms and refund policies.

Third-party links and services

The Service may link to or rely on third-party platforms — the Apple App Store, Google Play, analytics, and advertising providers. We aren't responsible for the content, policies, or practices of those third parties.

No warranty

The Service is provided "as is," without warranties of any kind, express or implied. We don't guarantee the Service will be uninterrupted, error-free, or that any data will never be lost — back up anything irreplaceable.

Limitation of liability

To the fullest extent permitted by law, 23 Degrees, LLC is not liable for any indirect, incidental, or consequential damages arising from your use of the Service, including loss of data stored locally on your device.

Indemnification

You agree to defend and hold 23 Degrees, LLC harmless from any claims, losses, or expenses (including reasonable legal fees) arising from your misuse of the Service or your violation of these Terms.

Termination

You can stop using the Service at any time by deleting the app. We may suspend or discontinue the Service, in whole or in part, at any time — since your content lives only on your device, discontinuing the Service does not affect memories you've already created.

Changes to these Terms

We may update these Terms from time to time. Continued use of the Service after a change means you accept the updated Terms.

Governing law

These Terms are governed by the laws of the State of Texas, USA.

Severability

If any part of these Terms is found unenforceable, the rest remains in full effect.

Entire agreement

These Terms, along with our Privacy Policy, make up the entire agreement between you and 23 Degrees, LLC regarding the Service.
